General Terms and Conditions of Sale – Embouts et Bouchons
These general terms and conditions of sale are concluded between:
– On the one hand: SARL GLUME with a capital of €1000, registered with the Bordeaux Trade and Companies Register under number RCS 911 140 689, whose registered office is located at: 22 rue de l’Oregon, 33600 PESSAC, hereinafter referred to as “the seller” as the owner and administrator of the website www.embouts-et-bouchons.fr
AND
– On the other hand: any natural or legal person wishing to make a purchase via the website www.embouts-et-bouchons.fr, hereinafter referred to as “the buyer”
1 – PURPOSE
These general terms and conditions of sale aim to:
- Inform the buyer of the terms and conditions of sale and delivery of products listed on the website www.embouts-et-bouchons.fr
- Formalize the rights and obligations of each party following a purchase on the website
By validating their order, the buyer accepts and agrees to these terms of sale without reservation.
The seller reserves the right to review and modify these terms. However, the version of the general terms and conditions of sale applicable to an order is the one online at the date and time the order is validated by the buyer.
2 – PRODUCTS AND SERVICES
The products and services concerned are those appearing in the catalog posted online by the seller.
If a product is not available in the seller’s stock and has been withdrawn from the market by a supplier, the seller undertakes to provide the buyer with a product of equivalent quality and price, or, at the buyer’s request, can also proceed to refund the sums paid and cancel the order.
Product photographs and topographies are those provided by the manufacturer and are given for information purposes by the product manufacturer or supplier; under no circumstances can the seller be held liable in the event of an error. The product photographs are as representative as possible but cannot guarantee a perfect likeness. The photos and visual descriptions therefore do not constitute a contractual commitment as they are subject to change without notice by the suppliers.
3 – PRODUCT AVAILABILITY
The products offered on the website are generally in stock and will be shipped within a period between 1 day and 7 days.
In the event of the unavailability of one or more products in an order, the seller undertakes to communicate via email the restock time announced by its supplier.
Thus, the buyer may choose whether or not to confirm their order; if they decide to maintain it, a partial shipment may be made**, the remainder will either be delivered later, replaced, or fully refunded. In any case, if the buyer chooses to cancel the order, it will be free of charge. (**) : a partial delivery may be offered if the total order amount is greater than €100 including tax, for Metropolitan France only (excluding Corsica); except for heavy and/or bulky items.
If the buyer opts for a refund, the seller will execute the refund of the sums paid by the buyer as soon as possible and at the latest within 72 hours.
4 – PRICING
4.1 Product Pricing
Product prices displayed on the site are in Euros and include all taxes applicable on the day of the order.
The price applicable to a product is exclusively the one appearing on the product sheet; if a price were to be different in a newsletter, on a site other than www.embouts-et-bouchons.fr, or on any other location on the site, the price on the product sheet shall prevail. The displayed product price does not include shipping costs.
The applicable price is the one corresponding to the date of validation of the order by the customer.
4.2 Shipping Costs
A contribution to shipping costs is required for any delivery whose price is less than €49 including tax; the shipping rate will differ according to the chosen carrier and the type of product ordered: however, it will be displayed on the order form.
PLEASE NOTE, this free shipping threshold does not apply to deliveries outside of Metropolitan France and for products whose size requires the use of a specific carrier. It also does not apply to customers holding a “PRO” account.
4.3 Customs Duties & Local Taxes
In the event of shipment outside the territory of Metropolitan France (including Corsica), customs duties and local taxes may be applied upon delivery of the order or a part of the order. These additional costs are calculated and billed locally by the customs or administrative services of the delivery country selected by the buyer. These additional costs issued and billed by customs or administrative services, independent of the seller’s control, are – if applicable – the responsibility of the buyer.
4.4 Price Variations
Some prices may differ for a limited time during commercial campaigns such as promotions. Other prices may also change over time based on revisions to the seller’s pricing policy or negotiations with suppliers.
These variations shall in no case entitle the customer to a refund for an order or a product validated outside of the promotion period, for example.
5 – ORDERS
5.1 Buyer eligibility
The buyer places their order on the site following the process in effect on the website.
Only persons with the legal capacity to enter into contracts are authorized to confirm an order on the site.
5.2 Buyer registration
A buyer wishing to purchase a product or service via the website for the first time must register as a customer of the site. They must therefore agree to provide the following information:
– Last and first names
– Postal address
– Email address
– Phone number
5.3 Placing the order
To correctly place an order, the buyer must select the product(s) and service(s), specifying their choice as precisely as possible, for example: reference, dimensions, color…
They must also indicate the payment method they intend to use to pay for their order and provide the most accurate delivery address possible (building, floor, access code, contact person for receipt, etc.) along with a phone number that will be provided to the carrier to schedule an appointment if necessary.
5.4 Order confirmation
Confirming the order implies the buyer’s acceptance of these general terms and conditions of sale and validates that they are legally capable of entering into a contract.
After verifying the information on the order summary (total amount, addresses, etc.) and correcting any potential errors, the order must be confirmed:
– by authorizing the secure credit card payment via the virtual payment terminal
– by confirming via one of the other proposed payment methods (bank transfer, administrative order, etc.)
6 – PAYMENTS
To pay for their order, the buyer has the following payment methods available:
- By credit card via a secure remote virtual payment terminal in SSL mode by STRIPE
- By bank transfer (bank details will be provided when this payment method is selected)
- By Administrative Order for subject local authorities and public bodies
In the case of payment by credit card, the debit is immediate.
In the case of payment via bank transfer or administrative order, we will ship your package upon receipt of the transfer in our bank account or receipt of payment authorization from your third-party organization.
In the event of a partial shipment with remaining item(s) upon customer request, the full amount of the order will be debited. Indeed, only one debit can be processed per transaction.
The seller reserves the right to cancel or suspend any order in the event of non-payment of any or all sums due to the seller.
IMPORTANT: During payment by card via the virtual terminal, no banking data is transmitted to the seller, and it is therefore neither stored nor saved by them.
7 – TRANSFER OF OWNERSHIP
The goods remain the property of the seller until full payment has been received from the buyer.
8 – DELIVERIES
Orders will be delivered to the delivery address specified during checkout.
Transfer of risk: In accordance with Article L216-3 of the Consumer Code, for consumer buyers (individuals), the risk of loss or damage to the goods is transferred to the buyer at the moment they, or a third party designated by them, take physical possession of the goods. For professional buyers, the transport risk is assumed by the buyer from the moment the goods leave the seller’s warehouse.
Receipt and reservations: It is strongly advised that the buyer unpacks and checks the condition of the product(s) in the presence of the carrier in order to make precise reservations on the delivery note, indicating any damage observed, or to refuse the package if the goods are damaged. The seller advises the recipient to keep the delivery receipt carefully. These steps greatly facilitate the handling of disputes with the carrier.
In accordance with Article L133-3 of the Commercial Code, if the consumer buyer has not had the opportunity to verify the good condition of the goods upon delivery, they have a period of 10 days following receipt to notify the carrier of any damage or partial loss via registered letter. In case of reservations, the buyer is invited to provide a copy of this letter or to inform the seller within 72 hours of the delivery date.
Transport times from the seller’s premises to Metropolitan France (including Corsica) and their costs are as follows:
- Via Mondial Relay or ChronoPickup: 3 to 4 working days for small orders weighing less than 30 kg. The fee for this service is between €2.99 and €29.99 (excl. tax) depending on the weight of the order.
- Via La Poste: 3 to 7 working days for small orders weighing less than 30 kg. The fee for this service is between €2.90 and €9.99 (excl. tax) depending on the weight of the order.
- Via Colissimo Home Delivery: 48 to 72 working hours for small orders weighing less than 30 kg. The fee for this service is between €7.95 and €49.99 (excl. tax) depending on the weight of the order and shipping method.
- Via Chronopost: 24 to 48 working hours for small orders weighing less than 20 kg. The fee for this service is from €14.90 to €49.99 (excl. tax).
The seller reserves the right to modify the selected delivery method if the prepared package(s) are incompatible with the standards of the carrier initially chosen by the buyer during the order. In this case, the buyer will receive an email from the carrier informing them of the handling and shipment of the package(s).
9 – GUARANTEES & AFTER-SALES SERVICE
In accordance with the legal provisions in force, products are covered by the legal guarantee of conformity (Articles L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).
Legal guarantee of conformity: Consumer buyers have a period of two (2) years from the delivery of the goods to act. They can choose between repairing or replacing the goods, subject to the cost conditions provided for by law. Guarantee against hidden defects: The buyer may decide to enforce the guarantee against hidden defects of the sold item. They have a period of two (2) years from the discovery of the defect to act and can choose between the rescission of the sale or a reduction in price.
PLEASE NOTE: No warranty shall apply in the event of misuse of the product, any modification not expressly validated by the seller (in writing), or any external intervention by persons not authorized by the manufacturer.
IMPORTANT: Any return must be previously agreed upon with the product seller. After contacting the product returns department (details at the bottom of this document), the product will be assigned a return number, and the buyer will receive a return slip that must be included with the return. Return shipping costs are the responsibility of the buyer. If the returned product proves to be free of defects and in perfect working order, processing and labor fees may be applied. In this case, reshipping costs will also be requested. Any product returned without this agreement and this return slip will be refused by the seller and returned to the buyer.
10 – WITHDRAWAL & PRODUCT RETURN
10.1 Right of withdrawal
The buyer has 30 clear days (instead of 14 days in accordance with Article L 221-18 of the Consumer Code) from the date of receipt of the product to return the ordered products to the seller.
Geographical limitation: The right of withdrawal, as well as the associated reimbursement of initial delivery costs, applies exclusively to buyers whose delivery address is located in France or in a member country of the European Union. For any order shipped outside the European Union (e.g., Switzerland), the buyer does not benefit from any right of withdrawal. Any return for these destinations is subject to the prior and discretionary agreement of the seller. In the event of an exceptional acceptance of a return from a non-EU country, only the amount of the returned products will be refunded. The initial shipping costs (“outbound”), return costs, as well as any customs duties and local taxes remain, in all cases, the sole responsibility of the buyer.
Any product return following the exercise of the right of withdrawal will be at the buyer’s expense and must scrupulously respect these principles:
– Be in perfect condition for resale
– Be returned in its original packaging in perfect condition with all parts delivered with the product (manuals, accessories…)
– Respect the return procedure described below
PLEASE NOTE: In accordance with Article L121-20-2 of the Consumer Code, the right of withdrawal does not apply to the following products or services:
– Specific products clearly personalized by the buyer (special colors, engraving…).
IMPORTANT: No product return in the exercise of the right of withdrawal can be accepted if it does not meet these conditions. This is why the seller strongly encourages the buyer to remove the product from the packaging with the utmost care and to keep it. If the packaging is damaged, a depreciation of up to 25% of the new value of the product, including taxes, may be applied to the credit note or refund of the product.
10.2 Product return procedure
Products may be returned if they have a conformity defect, a hidden defect, or when exercising the right of withdrawal.
Products must be returned to the product returns department, whose contact details can be found at the end of these general terms and conditions of sale.
For the exercise of a right of withdrawal, return shipping costs are borne by the buyer, who must specify whether they desire a product exchange, a store credit valid on the website catalog, or a refund.
A product return request may be made beforehand by the buyer, specifying whether they desire a store credit, a refund, or a product exchange in return for their product. This procedure is intended to process the file more quickly.
11 – LIABILITY
The seller is bound by an obligation of means and is responsible for the proper execution of the order. However, the seller cannot be held responsible for the partial or total non-execution of the order in the event of force majeure, causes attributable to the buyer, or one or more unforeseeable and insurmountable event(s).
The seller cannot under any circumstances be held responsible for the misuse of a product or service by the buyer.
IMPORTANT: In the event of product or material incompatibility, the seller cannot be held liable, and no compensation or refund can be made outside of the exercise of the right of withdrawal.
In any case, the seller’s liability will be limited to the total amount of the order, including all taxes.
12 – PERSONAL DATA
In accordance with current European regulations, and in particular the General Data Protection Regulation (GDPR) of April 27, 2016, as well as the amended “Informatique et Libertés” law, the client is informed that the collection of some of their personal data is necessary for the processing of orders placed on the website.
The seller reserves the right to disclose certain information to its commercial partners (particularly carriers) solely for the purpose of ensuring the proper execution of the order.
Naturally, the buyer or any other person who has provided personal information to the seller has the right to access, rectify, erase, limit, and object to the processing of their data. At any time, a request for modification or deletion of this data can be made by writing via email or by mail to the seller’s customer service department, whose contact details are provided at the bottom of these general terms and conditions of sale.
13 – INTELLECTUAL PROPERTY
The website www.embouts-et-bouchons.fr and all elements appearing therein are and remain the property of the seller.
Any reproduction, partial or total, by the buyer or any other person is not authorized.
Any link to the website (simple or hypertext) is not authorized without express agreement confirmed in writing by the seller.
14 – ARCHIVING AND PROOF
The seller will keep a copy of purchase orders and invoices on a reliable medium in accordance with the provisions of the Civil Code.
These elements may be considered as proof in the event of a dispute between the parties of this contract.
15 – DISPUTE, MEDIATION, APPLICABLE LAW AND JURISDICTION
15.1 Mediation Service
In the event of a dispute between the professional and the consumer, they shall endeavor to find an amicable solution.
Failing an amicable agreement, the consumer has the possibility to refer the matter free of charge to the consumer mediator to which the professional belongs, namely the Association of European Mediators (AME CONSO), within one year from the written complaint sent to the professional.
The referral to the consumer mediator must be made:
– either by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com ;

15.2 Applicable law and jurisdiction
These general terms and conditions of sale are subject to French law.
Any dispute concerning the interpretation, execution, or termination of the contract shall be submitted to the competent court in accordance with common law conditions.
